1. PARTIES

These Membership Terms and Conditions of METAFLIX Medya A.Ş. (“METAFLİX”) and the user who wants to benefit from the services to be provided by METAFLİX, in order to determine the procedures and principles regarding the membership conditions.

2. WHAT IS METAFLIX MEMBERSHIP?

METAFLIX, its members can access movies, documentaries, TV series, news content, etc. over the Internet via television, computer, telephone and all devices/methods that allow its members to access METAFLIX. It offers a personalized membership service that allows access to all kinds of content on METAFLIX free of charge for certain periods. Some METAFLIX content may be temporarily downloaded and viewed offline on various supported devices. Restrictions may exist, including the number of content that can be watched offline, the time it takes to start watching, and the amount of time it will remain watchable.

3. MEMBERSHIP

3.1. After the person has read the contents of all these membership conditions completely, clicks on the `I Accept the Membership Conditions` button in the electronic environment and the membership process is realized when the acceptance statement is recorded in METAFLIX. The Member accepts and declares that he/she has knowledge of the basic features of the digital content services and all other matters in accordance with the relevant legislation and that these membership conditions are binding.

3.2. METAFLIX membership continues for a limited period of time determined by METAFLIX as long as the member's will to receive service continues and he complies with the membership rules. In order to use the service provided by METAFLİX, the METAFLİX member must have Internet access and a device that supports the METAFLİX service.

3.3. In order to become a member of METAFLIX, it is necessary to reach the age of 18 or to reach the age of majority in the region or country where the member is located. It is not possible for minors to become a member of METAFLİX, and they must be under the supervision of an adult in order to benefit from METAFLİX services.

4. CHANGES TO MEMBERSHIP TERMS

METAFLIX reserves the right to make changes in the membership conditions. However, any changes made to the membership conditions will be effective at the earliest 30 (thirty) days after notification to the member.

5. RESPONSIBILITIES OF THE MEMBER

5.1. The Member accepts and undertakes that he will act in accordance with all applicable legislation while receiving services and that he will comply with the restrictions arising from the legislation and terms of use in the purchase of this service. Accordingly, the member shall not reproduce, modify, distribute, display, publish, mediate, process or reuse the content and information obtained through the service to be offered by METAFLIX -without the means and scope permitted by METAFLIX-, or otherwise. It is deemed to have accepted that it will not manufacture, sell or lease products. In addition, the member undertakes not to disable, change or disrupt any of the protections created by METAFLIX. Any sharing by the Member regarding the content on METAFLİX is the responsibility of the Member, and METAFLİX is not responsible for the Member's shares in any way. In so far, the Member will act with the awareness that the content of METAFLIX, which provides services under certain conditions and in accordance with the Membership conditions, on other platforms may be contrary to the provisions of the relevant legislation, in this context, he will not make any demands from METAFLİX under any conditions, all responsibility belongs to him. accepts, declares and undertakes that

5.2. The Member shall not use robots, spiders, scrapers or other automated means to access the METAFLIX service. In addition, the Member shall not decompile or disassemble any software or other products or processes accessible through the METAFLIX service; not to place any code or product in the content of the METAFLIX service or to manipulate in any way; not to use any method of data generation, data collection or extraction; not to upload or post any material designed to interrupt, damage or limit the functionality of any computer software or hardware associated with the METAFLIX service or telecommunications equipment, including any software virus or any other computer code, files or programs, - agree not to send or transmit by post or otherwise.

5.3. As stated above, the member is obliged to act in accordance with all kinds of rules imposed on him by the current legislation. In the event that the member violates the specified and other obligations arising from the current legislation, his membership may be terminated and METAFLİX is not liable for any damages caused by the member to 3 persons, as all kinds of claims and lawsuits regarding the surplus are reserved.

5.4. The member is responsible for all transactions realized through the METAFLIX account. In order to maintain control of the account and prevent others from accessing the account, the Member who owns the account should maintain control of the devices that support METAFLIX used to access the service and should not share the password of the account with anyone. In case the account holder realizes that his account has been used without the consent of the Member, he has the obligation to notify METAFLIX of this situation and to change the password. Otherwise, METAFLIX may terminate or suspend the Membership.

5.5. The member fulfills all the necessary terms and conditions for METAFLİX Membership, especially on the condition that he is over the age of 18, that any information he shares with METAFLİX is correct and up-to-date, and that any liability and responsibility that may arise from the aforementioned information being up-to-date and/or inaccurate is personally liable. accepts, declares and undertakes that it belongs to him.

5.6. The Member accepts, declares and undertakes that no commitment is made regarding the content and the diversity of the content to be provided by METAFLİX, and that METAFLİX has the right to increase, decrease and change the contents as it wishes.

5.7. The Member accepts, declares and undertakes that these Membership Terms will remain valid even if he becomes a METAFLİX Subscriber in return for a certain service fee.

6. IMAGE QUALITY OF METAFLIX CONTENTS

The condition of being able to benefit from the content that METAFLIX will offer to its members is that the member has technological opportunities that make it possible to access METAFLİX. The ability of the member to benefit from the METAFLIX service may vary depending on the usage environment and technical competence. The Member accepts and undertakes that he/she will have the most up-to-date version of the necessary software and technical facilities to access METAFLİX. Image quality of METAFLIX contents may vary from device to device. Again, the image quality can be affected by various factors such as the location of the member, the speed of the internet connection and the bandwidth it offers. In other words, the quality of the service image that the member will receive depends on HD, Ultra HD and HDR options, your internet service and the possibilities offered by the device. METAFLIX cannot offer all its content in all formats such as HD, Ultra HD or HDR, and not all membership plans allow the member to watch content in all formats. Default playback settings on cellular networks exclude HD, Ultra HD and HDR content. The minimum connection speed required to access Standard Definition quality content is 0.5 Mbps. It is recommended to have a download speed of at least 5.0 Mbps per stream to view HD content. A minimum download speed of 25.0 Mbps per stream is recommended for viewing HDR and Ultra HD content. The time it takes for the member to start watching the contents will vary depending on various factors such as the member's location, current bandwidth, selected content and the configuration of your device that supports METAFLIX. It is not possible for the member to make a request from METAFLİX due to the fact that the member cannot benefit from the service offered at the highest level due to the current technical impossibilities.

7. NON-TRANSFERABLE AND GEOGRAPHICAL LIMITATION OF MEMBERSHIP RIGHT

The METAFLIX service and any content watched over the service are for the personal and non-commercial use of the member. A limited and non-transferable right is provided to the member, allowing them to access the METAFLIX service and view free content. The aforementioned membership is deemed to have accepted in advance that the Member will not transfer the rights brought by the membership under any circumstances.

METAFLIX contents can be watched in the country where the member is resident and in the geographical regions where the said content is licensed. Content that can be watched will vary by geographic region and may change from time to time.

8. MISCELLANEOUS PROVISIONS

If any provision or provisions of these terms of membership are declared invalid, illegal or unenforceable, the validity of the remaining provisions shall not be affected.

METAFLIX may, at any time, transfer and assign its rights and obligations regarding the membership relationship established by accepting these membership conditions. By becoming a member of METAFLIX, it is accepted in advance that consent will be given to this possible transfer or assignment.

Any information regarding the membership account will be transmitted to the member only in electronic format. In this context, it is important to share current and usable contact information with METAFLIX at the beginning of the membership process. If there is a change in the contact information given to METAFLIX by the member, this change must be reported to METAFLİX immediately. It is accepted that the member is aware of the content sent to the member contact address within the same day.

The member, the interruption in the service, image quality and security problems and / or the emergence of a general confusion in the country due to interruptions in the internet, speed reduction and similar reasons, war, terrorism, strike, general power outage, earthquake, flood, state of emergency, cyber attack, METAFLİX accepts and undertakes that it will not be responsible for the problems that may arise regarding the delivery of the service due to the fact that the devices are infected with a virus or a similar force majeure reason.

METAFLIX has no responsibility for the products or services that are the subject of advertisements in the application or linked links.

9. MEMBERSHIP CANCELLATION

The member will always be able to cancel his METAFLİX membership without giving any reason. In case of cancellation of membership, he/she will not be able to benefit from METAFLİX service as of the date of cancellation.

10. LIMITATION OF LIABILITY

METAFLIX does not make any commitments regarding the uninterrupted or flawless service provided. While it is METAFLIX's most important goal to serve its members in the best possible way, some malfunctions and defects may occur in the services provided. For this reason, the Member agrees in advance that he waives all special, indirect or consequential damages against METAFLIX and will not demand any refund. This acceptance shall not limit any warranties that cannot be waived or any rights the member may have under the laws of the country of residence. METAFLIX is not responsible for the similarities of the content or programs presented in any medium with the materials or ideas transmitted to METAFLIX.

11. CUSTOMER SERVICE TEAM

In order for the customer service team to best assist the Member when the Member needs it, it may be necessary to use a remote access support tool that allows them to have full access to the Member's device. In cases where the member does not prefer to have his device accessed remotely, he must notify the customer service team. In such a case, it is the duty of the customer service team to assist the Member in other ways. If there is a difference between the content of these membership conditions and the information provided by the Customer Service team, Members must respect these membership conditions.

12. RESOLUTION OF DISPUTES

Azerbaijan courts are authorized in disputes that may arise from these membership conditions.

13. EFFECTIVENESS

These membership conditions will come into effect as soon as the `I Accept the Membership Terms` button is clicked on the electronic environment after reading the specified contents completely and the acceptance statement is entered into the METAFLIX records and will remain in effect until canceled by any of the parties.
